General Terms and conditions

1. Scope

All orders conducted by consumers and entrepreneurs via our online-shop shall be governed exclusively by the following general terms and conditions.

A consumer is any individual concluding a legal transaction for purposes which can not be attributed mainly to commercial or self-employed occupational activities. An entrepreneur is an individual or a legal entity concluding a legal transaction in execution of their commercial or self-employed activities.

Valid for entrepreneurs: if the entrepreneur uses opposing or enhanced general terms and conditions, application of those is objected to. They become component of the contract only if we have expressely agreed to.

2. Contract partner, Contract conclusion

The purchase contract is concluded with EInkStation.

By means of presentation of products in the online shop we submit a binding offer for contract conclusion regarding the specific article. You can initially place our products into the shopping cart without obligation and correct your inputs any time before placing your binding order by using the proofing tools offered and explained during the ordering process. The contract is concluded by clicking the order button and thereby accepting the offer covering the products in the shopping cart. Directly after placing your order you will receive a corresponding confirmation via E-Mail.

3. Contract language, Storing of contractual text

The languages available for contract conclusion are german and english.

We store the contract text and will send order data as well as general terms and conditions in text form. For security reasons, the contract text is not available via the Internet any longer.

4. Delivery conditions

We deliver free of shipping cost.

Delivery is only via digital download. Wir liefern nur im Versandweg. Pickup by customer is not possible.

We do not deliver to packing stations.

5. Payment

Our shop offers the following payment possibilities:

Credit card
With placing your order you provide your credit card data. After being legitimized as legally entitled cardholder the payment transaction is carried out automatically and your card is charged.

PayPal, PayPal Express
During the ordering process, you will be directed to the website of online provider PayPal. To pay the invoice amount via PayPal, you need to be registered there or need to register first, legitimize with your login details and confirm payment excecution to us. After placing the order in the shop we apply to PayPal for execution of payment transaction. The payment transaction will be carried out by PayPal automatically. Further indications will be given during the ordering process.

PayPal Plus
In the context of the payment service PayPal Plus we offer various Payment methods as PayPal Services. You will be redirected to the website of online provider PayPal where you can enter your payment data, confirm usage of your data by PayPal and confirm payment excecution.

If you have selected payment method PayPal, you have to be registered there or register first and legitimize with your login data in order to be able to pay the invoice amount. Payment transaction is carried out by PayPal directly after confirming payment excecution automatically. Further indications are given during ordering process.

Credit card via PayPal

If you have selected payment method credit card, you do not have to be registered with PayPal in order to pay the invoice amount. Payment transaction will be carried out by your credit card company on request of PayPal immediately after confirming payment execution and legitimization as legally entitled cardholder and charged to your card. Further indications are given during the ordering process.

Direct debit via PayPal

If you have selected payment method direct debit, you do not have to be registered with PayPal in order to pay the invoice amount. By confirming payment execution you grant a direct debit mandate to PayPal. You will be informed by PayPal about the date of debit entry (so called Prenotification). By presenting the direct debit mandate directly after confirmation of payment excecution, PayPal will request its bank institute to execute payment transaction. Payment transaction is executed and charged to your bank account. Further indications are given during the ordering process.

Sofort by Klarna

After placing the order, you will be directed to the website of online provider Sofort GmbH. To pay the invoice amount via Sofort, you need to have a bank account registered for online banking, legitimize accordingly and confirm payment excecution to us. Further indications are given during the ordering process. The payment transaction will be executed directly after by Sofort and your account will be charged.

6. Right of revocation

Consumers have a right of revocation as described in cancellation policy. Entrepreneurs are given no voluntary right of revocation.

7. Warranty

As long as not expressly agreed differently, the statutory warranty rights are valid.
For purchase of used goods by consumers, the following rules apply: claims for defect are excluded after expiration of one year after purchase. Under the statutory warranty period, defects ocurring within one year after purchase can be claimed within two years after goods delivery.
For entrepreneurs, limitation period for defect claims for newly produced goods is one year after transfer of risk. Sale of used goods is conducted with exclusion of any guarantee. Legal limitaton periods for right of recourse according to Par.445a of german civil code (BGB) remain untouched.
Against entrepreneurs, condition of goods are agreed only by our own descriptions and product descriptions of manufacturers included in the contract, we take no responsibility for public statements or further advertising statements of the manufacturer.
If the delivered good is defective, we grant warranty by means of defect remediation or by delivery of defect free goods.
Aforementioned limitations and time limitations are not valid for claims due to defects caused by us, our legal representatives or subcontractors
• for damage to life, limb and health
• in case of intentional or grossly negligent breach of duty or fraudulent intent
• due to breach of major contractual obligations, whose fulfilment is prerequisite for proper fulfilment of the contract in the first place and on where the contractual partner routinely can rely on their observance (cardinal duties)
• in context of a guarantee commitment, if agreed
• if application of product liability act is given.

8. Liability

For claims for defects caused by us, our legal representatives or subcontractors we shall in any case be liable without limitation

• for damage to life, limb and health
• in case of intentional or grossly negligent breach of duty or fraudulent intent
• for guarantee commitments, if agreed

• if application of product liability act is given.

In case of breach of major contractual obligations, whose fulfilment is prerequisite for proper fulfilment of the contract in the first place and where the contractual partner routinely can rely on their observance (cardinal obligations) due to slight negligence on our side, our legal representatives or subcontractors, liability shall be limited to the amount typical to and foreseeable at conclusion of the contract. Otherwise, further claims for damages are excluded.

9. Dispute resolution

The european commission provides a platform for Online dispute resolution (OS), which can be found here . We are not obliged and not prepared to participate in a dispute settlement procedure before a consumer arbitration board.

10. Final clauses

If you are a company, german legislation is applicable to the exclusion of the UN sales convention.
